A customer’s mobile service was terminated following ongoing disputes and unusually high levels of contact with their provider.

Background

The customer raised multiple complaints about plan‑pricing changes through several channels, including the provider, TDR, and the Disputes Tribunal. They also frequently requested copies of information, which ultimately led to several referrals to the Privacy Commissioner. After all external processes concluded, the provider chose to end the contract, stating that the customer’s expectations and communication patterns had become unreasonable. The customer considered the termination retaliatory and returned to TDR with a new complaint.

Next steps

TDR reviewed the full set of submissions and evidence from both parties. The provider showed that its terms allowed for contract termination under specific conditions, including unreasonable or excessive behaviour. They also provided evidence that the customer repeatedly disputed established facts regarding plan changes and had contacted the provider at a rate far higher than the average customer.

Outcome

TDR found that the provider had made sustained efforts to respond to the customer’s concerns, provide clarification, and attempt to resolve matters. The level and nature of the customer’s communication was assessed as excessive and unreasonable. TDR concluded that the provider’s decision to terminate the contract was both permitted under their terms and reasonable in the circumstances. The complaint was therefore not upheld.

Lessons learned

This case highlights the importance of managing customer communications effectively and setting clear expectations early, especially when concerns escalate or become repetitive.

Service providers should document all interactions thoroughly and ensure customers receive consistent, accurate information to minimise misunderstandings. It also reinforces that while customers have the right to raise concerns and seek clarification, excessive or unreasonable communication can hinder resolution and impact the ability to maintain a constructive relationship.

Clear communication, reasonable expectations, and mutual respect are key to avoiding similar situations.
